8507.60.00.10 from Romania resolves to 10.00%: no Column 1 rate on file and one trade remedy on top of it. That is one line of many under lithium-ion batteries. Rates within the category differ, so the figure is what this line draws rather than a rate for the category as a whole.

Considered and not applied

Section 232U.S. note 33(g) reaches this provision only where the article is in fact a part of a passenger vehicle or light truck, and U.S. note 38(i) only where it is a part of a medium- or heavy-duty vehicle. The note enumerates the whole heading, which also covers articles that are not vehicle parts, and the classification does not record which is which. An article in the heading that is not a vehicle part is entered under heading 9903.94.06 or 9903.74.11, which carry the duty of the applicable subheading and no additional duty, so the 25 percent is not included above. Add it where the article is a vehicle part.
Section 301Applies only where the Column 1 rate is at or above 10%. The Column 1 rate here is 3.4%.
Column 1 General (MFN)Heading 9903.05.39 states a rate that applies in lieu of the Column 1 rate, under U.S. note 1 to subchapter III of chapter 99.
Read with care.
  • Heading 9903.94.05 covers 8507600010 only where the article is a vehicle part, which the classification does not record. It is not included in the total.

What is in scope

Section 301 reaches lithium-ion batteries under Chapter 99 heading group 9903.91 and the provisions of HTS 850760. The full list of classifications and the instrument behind the action are on the lithium-ion batteries page.

Romania also faces a country-wide additional duty of 10.0%, applied as a cap on the combined duty rather than a surcharge upon it, reported under 9903.05.39. That reaches goods of Romania whatever they are. The Romania page sets out every action reaching that origin.

Reading this figure

Duty is assessed at the ten-digit statistical line, not at the category and not at the four-digit heading. A different line under lithium-ion batteries can carry a different Column 1 rate and, where a trade remedy enumerates provisions rather than a whole chapter, a different set of layers. The calculator resolves a specific code, origin and value.

For what each layer above is: Section 232, Section 301, Section 338, how the layers combine.
